Terms of service.
By accessing or using Sorvyn ("we", "us", "our", "the service"), you agree to these Terms & Conditions. Please read them carefully before using our platform.
Sorvyn provides communication and automation services on behalf of service businesses. This includes managing customer inquiries and conversations across website chat, website contact forms, SMS/text messaging, and email. Sorvyn acts as a service layer on behalf of the businesses it works with — not as a direct party to the customer relationship.
- Website chat — answers visitor questions on the business's website in real time.
- Website contact forms — processes inquiries and replies by email or SMS.
- SMS / text messaging — replies to customer texts and missed calls, and (with prior consent) sends payment reminders, no-show recovery, review requests, and win-back messages.
- Email — replies to inbound email and web-form inquiries on behalf of the business.
All communication facilitated by Sorvyn is either customer-initiated or sent to customers who have given prior consent. Sorvyn is never used for unsolicited outreach, cold messaging, purchased lists, or bulk promotional campaigns.
Detailed consent rules for each channel and agent are set out in our Messaging & Consent Policy, which forms part of these Terms. SMS communications are designed to follow the U.S. Telephone Consumer Protection Act (TCPA) and CTIA Messaging Principles & Best Practices; email follows applicable anti-spam laws such as CAN-SPAM.
For any business-initiated messaging — including payment reminders, no-show recovery, review requests, and win-back — the business must have obtained prior express consent from the customer to be contacted on that channel, and must confirm this within the Sorvyn dashboard before messages are sent. A past appointment, purchase, or missed appointment alone does not constitute consent. The business is solely responsible for:
- Obtaining valid consent through a lawful method (signed/digital form, prior text or email agreement, or documented written/verbal agreement)
- Keeping auditable records of that consent (date, time, method, phone/email, name, and scope) and producing them if a dispute arises
- Not uploading, entering, or messaging contacts for whom valid consent does not exist
- Honoring opt-outs and not attempting to re-contact opted-out customers
All messages sent through Sorvyn are:
- Sent in response to a customer-initiated contact, or to a customer who has given prior consent
- Related specifically to the subject matter of the inquiry or the business relationship
- Sent on behalf of the business — Sorvyn is the delivery mechanism, not the sender of record
- Inclusive of opt-out information (STOP for SMS; unsubscribe link for email)
- Not used for unsolicited marketing, promotional blasts, or bulk outreach
Businesses using Sorvyn are responsible for:
- The accuracy of business information, service descriptions, hours, pricing, and FAQs provided to Sorvyn for use in responses
- Obtaining and retaining all required customer consent, as described above and in the Messaging & Consent Policy
- Ensuring their website forms include appropriate privacy disclosures and links to these Terms and the Privacy Policy
- Complying with all applicable laws and regulations, including the TCPA, CTIA guidelines, CAN-SPAM, GDPR (where applicable), and any other relevant communication or privacy laws in their jurisdiction
- Keeping their business contact phone number accessible, as required for messaging verification
You agree not to use Sorvyn to:
- Send unsolicited, deceptive, or unlawful communications
- Message contacts without valid, documented consent where consent is required
- Submit false, unauthorized, or third-party contact information without consent
- Send SHAFT content (sex, hate, alcohol, firearms, tobacco/cannabis) or other content prohibited by carriers
- Use the platform for bulk outreach, spam, or any purpose other than legitimate customer communication
- Buy, sell, rent, or share consent or contact lists
- Attempt to reverse-engineer, interfere with, or disrupt the service or its infrastructure
- Violate any applicable messaging, privacy, or consumer-protection laws
Access to Sorvyn is provided on a subscription basis. Each plan includes a monthly allowance of credits consumed when messages are sent on the business's behalf, as described on our pricing page. Plans are billed on a recurring basis and may be changed or cancelled in accordance with the arrangement agreed with the business.
All software, systems, workflows, and proprietary technology underlying the Sorvyn platform remain the exclusive property of Sorvyn. Businesses are granted a limited, non-exclusive, non-transferable right to use the service in accordance with these Terms. No ownership rights are transferred by use of the platform.
Sorvyn reserves the right to modify, update, or discontinue any aspect of the service at any time. We will provide reasonable notice of material changes where possible. Continued use following any changes constitutes acceptance of the updated Terms.
To the maximum extent permitted by law, our services are provided "as is" and "as available" without warranties of any kind, express or implied. We are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the service. Sorvyn is not liable for delays or failures in message delivery caused by third-party carriers, email infrastructure, spam filters, or other factors outside our control. Businesses are responsible for their own compliance with the laws governing their communications.
These Terms are governed by applicable law. Any disputes arising from or related to these Terms or the use of Sorvyn services shall be resolved in accordance with the laws of the applicable jurisdiction.
